New to Me 2008 Lr3 Warranty Question

Hello, I just purchased a 2008 LR3. Very happy with it. The warranty is still in effect. As I do with any used car purchase under warranty, I made a laundry list of all the issues I found and took it to the dealer. They are addressing most of it, however they are refusing to cover two things: (1) Driver door body seal is split open for about 4 inches at shoulder height. (2) Interior center console has a spot on the outside between the right cup holder and seat that has split open. The dealer is refusing to cover this and citing "outside influence". It does not help they are the only dealer in town, and that they did not sell me the car. Any recommendations on how to proceed or appeal? Am I out of luck? Thank you! Carlos
