Lets start with, whats your year of manufacture? Secondly, have the patches already been applied?
If you visit the dealer on occasion, the good shops automatically apply them. The better shops perform a diagnosis to ascertain if they are needed (thrown codes/vin, etc). The other shops ignore the whole shebang.

If you are under warranty, applying patches is covered if it fixes a problem you have reported that is warranty-covered.
Also, if you are under warranty, I don't believe that applying patches just to keep you updated is covered by warranty. I might be wrong on this. It's an interesting question whose answer may vary by vehicle manufacturer. The issue isn't a chargeback for the software, but the time a technician takes to apply it.

By the letter of the law, I believe you are right, @LR2driver ... However I stand behind 'MY' definitions of the "Good shops", "Better shops" and "the others" ;-)
