Default LR Protection Plan anyone have issues?

New to forum. Just a question on anyone having issues with Land rover Protection Plan 3rd Party Administrators/ adjusters.


Found nice used RRS 2013 almost mint conditions at a Maserati dealer in Florida. Had inspected and bought LR PP two months before factory warrantee when out in August, 2016.


Read agreement, wrote letter for clarification between a BREAKDOWN and WEAR and TEAR. Just some legal goodly gook wording. The replied with same wording.


Had a claim for a defective Tow Hitch receiver, call LRPP and they thought it was a covered part since it was not specifically excluded (Thomas), but said bring to a dealer for claim. Did so yesterday and 2X the adjuster denied the claims stating Exception #6 "Physical damage". Well when two opposing pieces of matter meet as they are designed to damage can occur. In my case the pit tip that activates Green locking system sheared off (in writing by tech) and failed to performed as designed and thus loss of use of hitch since it would not lock and falls out (functionality).


Well the service advisor keep saying " physical damage" denied claim.
The Exception #6 actually means if the damage can be covered under say a collision auto insurance policy, LRPP will not pay and that is logical, since you can obtain collision coverage. But the uses of "physical damage" here is out of contexts.


A Federal Court in INGRAM (2000) rules the expanded definition of "physical damage" meaning the" loss of use or functionality". Well the tow hitch harden pin, made in India did break/shear off as the tech stated, due to failure to lock properly, when trailing.


LR refuses to reply in writing on the alleged defects in the Quick Removable Tow hit Receivers as they advertised in their KIT publication 2010+ on the RRS. I have to go to arbitration, but in Florida it is non-binding and a waste of time and money, before I can take the parties to court. So be it.


Q has anyone else had a LR service advisor use the word " physical damage" which definition is used in penal law, but rules under INGRAM to mean the same as BREAKDOWN.


Last point called LR Customer Service, Used analogy" When we are a baby our lungs and heart are new, they work fine; as we get older there is WEAR and TEAR, would a health insurance carrier deny coverage if we have any issues in later life? She laughed and said good analogy!


Write me if you have had similar BS when you presented a claim, remember and administrator works on behalf of his principal LR>
