I just purchased a 2004 Discovery II from a local dealership less than a month ago. It has 71k miles and as such is still covered under the NYS lemon law. In the past week or so I've noticed the the shifts from 1st to 2nd are sometimes rough and seem to be getting worse. Is this simply typical behavior for a transmission that needs a fluid/filter change? Or should I be taking this in to the dealership for them to take care of? The lemon law warranty covers "the transmission case, internal parts, and the torque converter" and I'm not sure if this would apply.

I agree. If you're having that big of a problem with it so soon, take it back and have them fix it.
