Question Brake Pedal and Switch Questions

My 2003 Freelander's brake pedal does not always come up after braking and the result is (verified by my wife driving the car behind mine) that the brake lights are staying on! I was able to pull the pedal up with my foot and the lights stay out until I brake again. Almost seems like a spring to pull my pedal back up would fix the problem as the car does seem to brake well. I have read about brake switch problems and know that my car did go through a recall service for this some time ago. I have not pulled the switch to see if it is an early style or later style with the extra harness to wire it. Any thoughts on this, would be appreciated. Lights are working and no other problems are occuring so I am not sold on the switch explaining this. What other things will make the pedal not return properly (and shut of the lights)?

There was a recall on the stop light switches. They have been a cause of many issues. Get a new switch and install it. Make sure it has the updated electrical jumper/connector pigtail.
