In my DD, a Mercedes low to the ground, the fogs (actually a white light, not yellow as in older ones) provide a wide pattern of light that helps illuminate deer on the shoulder where the most tasty grass is. And this morning at 1:30AM I was "lit up" by more blue lights than I thought possible on a deputy's car, and a young deputy reminded me to dim those high beams. Yes, Sir.

Guess those Silver Stars really do work...

It sounds like they aren't really fog lights, or are not adjusted correctly. Actual and adjusted fog lights shouldn't be able to be mistaken for high beams.

Oh, the high beams were on also, I have hit three animals on the way home in the last year, taken out bumper, grille, head lights (several). But he approached me from behind, had not seen any on-coming traffic for several miles. I've been stopped on the same stretch of lonely county road several times by those guys and gals, I guess a Merc convertible at that time of night fits a profile of some kind, never got stopped in my Merc wagon or F250. And when they shine the light in your eyes (pupil check) and notice that you look like the Michelin man the threat level is relaxed.

But yes, the point is that law enforcement can decide that lights deserve a closer look. Also, if off road, don't use a Q Beam to "shine" deer or such. A pal was dong that in a brand new 4WD pickup, without off road lights, just to poke around, and when he pulled out of the woods the game wardens were waiting. They let him go without a "animal harrassment" citation, and warned him that had they found a gun in the vehicle the truck could have been siezed and sold at auction.

as long as we are dragging out the subject do any colors work better than others, I have seen both green and yellow fog lights.

We have a good bit of fog down here near the coast. I think I can see better with yellow. Everything is so green down here I don't know about that color, although the human eyeball response seems peaked in the green area.

If they would mow the right of way back futher from the road it would help, most deer want to stay within 15 feet or so of the trees. But I have hit deer, coyote, and hog, gonna have to get a huntin' permit one day. Heavy rains raise the water levels and animals are forced out of their habitat, body shops love the business.
