It is both headlights, and I do indeed have the Xenon lamps and it is only on startup. If I turn the ignition off and turn it right back on, the headlights do not wag at all. When I hooked up my IID tool today (about 7mins after the UPS guy dropped it off), I did see 2 faults - LH and RH headlights - short to ground. I cleared the faults as they were from Aug of 2015, and after reading faults again, they did not appear. I am wondering if this is something one of the PO's set up in Car Configuration...?
we changed ours to xenon. Maybe it's an issue with the upgrade?

I do have the foglights - guessing the xenons are an upgrade, as my foglights are halogen.
After I cleared the fault, the problem did NOT go away.

if you have fogs your car came with xenon headlights, that's why I asked.

SE came with and without the upgraded lighting package which was around a $2,000 option at time of purchase.
if you have Foglights, you should have xenon headlights and the automatic switch on the dash.
No Foglights equals halogen and no auto lights.
I had a customer come in with an 07' with auto lights and fogs, but halogens.
I asked if it had been in an accident and he replied a very small one. I told him his headlights had been changed and he was not sure.
Checked the date on the lights and they were from 05'.

Lots of good info! Thank you all - though I am no closer to solving my headlight mystery. I took the vehicle to the Land Rover dealer here in Wichita last week - the tech there was baffled as well. He also missed an obvious leak on my transmission (coming from the wire bundle) so my faith in that paticular service center is diminished...
