It is different if someone else's insurance is paying. You don't have a contract at all with them. You can make them do more.

Simple; tell the insurance to keep the check & bring you another car in the exact shape as yours was before the accident. Not a public fact, but that's the law.

Geez, Scope. Sorry to hear/read this news, but am glad you and your family are well. Your rejuvenation thread was really a great read.

If you have any inclination to do it all again, I would certainly attempt to negotiate to keep the totaled truck for parts. That way the next Disco will only cost you $1k to rehab.
